PUPPY SALES CONTRACT
This Golden Retriever Puppy (sex) is out of ____________ (AKC#__________) x______________, (AKC#__________). The litter was whelped on_______. This puppy has been sold for _______on _______________________(date).
This puppy must be registered with the American Kennel Club (AKC) before 12 months of age (date), and is being sold with an AKC Limited Registration. This puppy will be neutered at approximately 12-18 months of age, or as recommended by the Breeder and veterinarian. This puppy may not be registered with any other dog registry without the express written permission of the Breeder. This puppy may not be used for breeding at any time.
The above puppy is guaranteed to be in good health at time of sale. Buyer has 72 hours to have this puppy examined by a licensed veterinarian. If the puppy is found to have an illness or defect, hereditary or congenital at this time, which would not allow the puppy to be a viable ‘pet’, the Buyer may return the puppy for a refund with a written report from licensed veterinarian detailing the health concerns. All paperwork received from the Breeder will be returned to the Breeder in the case that a puppy is returned. The Buyer is responsible for any and all costs of the puppy’s return to the Seller. The Buyer is responsible for all vet bills incurred. After 72 hours, NO REFUND WILL BE GIVEN.
Health Warranty:
Sellers warrant that if the Puppy should be afflicted with debilitating hip dysplasia or cataracts, Sellers will refund one half of the purchase price of the puppy subject to the following conditions: 1. Buyer notifies Sellers promptly after such condition is diagnosed and not later than the Puppy reaching 26 months of age; 2. Buyer provides Sellers with documentation of the inherited genetic disease, and two veterinarians of sellers choice agree disease will lead to poor quality of life. 3. The Puppy must not have been bred if a female or must not have been allowed to sire a litter if a male; 4. The Puppy must have been maintained in good physical condition with good muscle tone through proper and age appropriate exercise and not allowed to become overweight, or kept confined in a crate or small enclosure. 5. The Puppy has received proper immunizations and monthly heart worm preventative (documentation required) 6. The Puppy must be neutered if a male or spayed if a female and documentation that the procedure has been performed must be provided to Sellers by the veterinarian that performed the procedure.
7. Debilitating means that the inherited defect will prevent the puppy from being a healthy pet as determined by two veterinarians of the sellers choice.
If at any time during the lifetime of this dog the Buyers are unable or unwilling to keep or care for the dog, it is to be returned to the Breeders and NO REFUND AND/OR MONETARY COMPENSATION WILL BE DUE to the Buyers. UNDER NO CIRCUMSTANCES, DURING THIS DOG’S LIFETIME, MAY OWNERSHIP AND/OR RESIDENCE CHANGE WITHOUT THE EXPRESS WRITTEN CONSENT OF THE BREEDERS. UNDER NO CIRCUMSTANCES, DURING THIS DOG’S LIFETIME, SHOULD THIS DOG EVER GO TO A RESCUE ORGANIZATION OR A “SHELTER”. If the Buyer fails to abide by these requirements, the Buyer will be responsible for all legal fees and any expenses incurred by the sellers, in returning the dog back to the Seller’s legal ownership and possession. The Buyer further agrees that the Seller has the right to repossess the dog at any time upon evidence of NEGLECT and/or ABUSE at no expense to the Seller. Should the Buyer not uphold any terms or covenants of this contract, the sellers then are within legal right to proceed with legal repossession of the dog and refund/owe no monies or other form of payment. Breeder shall not be obligated to reimburse any monies spent on dog while in Buyer’s possession. Buyer shall be obligated to surrender to Breeder all AKC registration papers, properly signed over to the Breeders, at the time of repossession. Buyer further agrees that Buyer is solely responsible for any and all actions of the Puppy and agrees to hold Sellers harmless from any and all claims for Bodily Injury and/or Property Damages caused or alleged to have been by the Puppy.
Both Buyer and Seller agree that that this contract may not be modified or rescinded unless agreed to in writing by both the Buyer and the Seller. Both Buyer and Seller further agree that the venue for any disputes that may arise out of this contract shall be in Smith county, Texas and governed by the Laws of the State of Texas.
