PUPPY SALES CONTRACT

This sales contract for the purchase of a female/male Golden Retriever puppy whelped (DOB)________________

Is between Colleen Maddox (Seller) and ____________________________________________(Buyer).

In consideration of payment in full of the purchase price of __________________________dollars ($__________)

by Buyer to Seller, Seller agrees to transfer to Buyer, subject to the terms and conditions contained in this contract, the ownership of one female/male Golden Retriever puppy, herein after referred to as the “Puppy” regardless of age, from the mating of the sire and dam identified below:  A deposit will be required to secure your puppy.  Deposits are not refundable.

BUYER’S ACKNOWLEDGMENT

Sellers have, to the best of their knowledge and ability, made a good faith effort to determine that the Puppy’s dam and sire are free of inherited genetic disease and have made this information available to Buyer.  Buyer, by signing this contract, acknowledges that he/she is aware that there are health problems that are not uncommon to the Golden Retriever breed.  Some of these potential health problems are known to be genetic, some are  believed to have some genetic predisposition, and the cause of others is unknown or is random in occurrence.  Buyer understands and acknowledges that Sellers cannot predetermine the outcome of the breeding and therefore can make no assurances that the Puppy will be free of inherited genetic or other disease, nor that the Puppy will meet Buyer’s expectations as respects conformation, performance, or temperament.

PICKUP/SHIPPING

As soon as is reasonably possible after the Puppy is seven weeks of age, Sellers will make the Puppy available to be picked up by the Buyer at Seller’s location, or Sellers will ship the Puppy to Buyer by conveyance agreed to by Sellers and Buyer and at a time reasonably convenient to Buyer.  Buyer shall provide a ship crate acceptable to the agreed conveyance, and Buyer shall be responsible for all shipping expenses, which shall be paid in advance of shipping.

PUPPY HEALTH AT PICKUP/SHIPPING

The Seller guarantees the Puppy to be in good health on the date of delivery.  Buyer agrees to have the Puppy examined by a licensed Veterinarian within 3 days of receipt of the Puppy.  If the Puppy is found to have an illness or defect, hereditary or congenital at this time, which would not allow the puppy to be a viable ‘pet’, then the Buyer shall elect to keep the Puppy or return the Puppy to the Seller for a refund.  If the Buyer elects to return the Puppy, Buyer shall, within 5 days after the date of the signing of this contract, send to Seller by certified mail a written Veterinarian’s certificate stating the health concerns.  Upon receipt by Seller of said certificate, Buyer shall be obligated to return the Puppy to Sellers at Buyer’s expense.  Upon receipt of the Puppy, the Seller shall be obligated to refund all monies received from Buyer toward the purchase price of the Puppy and further performance under this contract shall be null and void.  Under no circumstances will Seller be responsible for veterinary bills resulting from any such condition.

At time of delivery the Puppy will have it’s first shots, and will have been wormed.

BREEDING

The Buyer agrees not to use the Puppy (female or male) for breeding purposes.  Seller shall provide limited AKC registration.

BUYERS RESPONSIBILITIES

Buyer agrees to conduct him/herself as a responsible dog owner and shall maintain the Puppy in good condition, including adherence to a regular immunization schedule, heartworm preventative, parvovirus preventatives, Lyme’s disease vaccine in endemic areas, good diet, and a clean and safe environment.

Buyer agrees that Buyer is solely responsible for all costs and expenses of and related to the ownership of the Puppy including but not limited to feeding, veterinary care and training.

Buyer further agrees that Buyer is solely responsible for any and all actions of the Puppy and agrees to hold Sellers harmless from any and all claims for bodily injury and/or property damages caused or alleged to have been by the Puppy.

This Puppy is being sold with the intention of providing companionship to the Buyer for the rest of the Puppy’s natural life.  If for any reason the buyer cannot keep the dog, the Buyer agrees to contact the Seller of the circumstances.  Under no circumstances should the Puppy be placed in an animal shelter. 

Both Buyer and Seller further agree that the venue for any disputes that may arise out of this contract shall be in Smith county, Texas and governed by the Laws of the State of Texas.

We agree to the terms of this contract.

By signing the Contract of Sale, Buyer accepts all conditions contained herein.
